SALES CONTRACT – Border Collie
The Buyer,
_____________________, and the Seller, ______________________, hereby agree as
follows:
1. The Seller hereby sells to
the Buyer, ____________________________________________born, _____________________________200___
for $ _______ in accordance with the terms of this contract.
2. The Seller will
register the dog with the American Border Collie Association (ABCA) under the
name specified by the Buyer, and provide the registration papers to the Buyer
as soon as possible. The Buyer shall not register the dog or permit the dog
to be registered with the American Kennel Club (AKC).
3. The Seller
guarantees that the dog is in good health on the date of delivery. The Buyer
has the right to return the dog to the Seller within 7 days of delivery if the
dog is found by a veterinarian to be suffering from any disease for the amount
of the purchase price or deposits made to date.
4. The Seller
guarantees that the dog is free of hereditary defects to the best of his/her
knowledge. The Seller does not assume any additional liability for possible
genetic defects in the dog, and will under no circumstances be responsible for
veterinary bills resulting from any such condition.
5. The Buyer shall maintain the
dog in good condition, including adherence to county and state licensing regulations,
regular immunization schedule, good diet, and a clean and safe environment.
6. If the dog is found in the
custody of animal control, wandering loose, and/or unattended, the Buyer shall
relinquish rights and custody of the said dog back to the Seller at no cost to
the Seller.
7. Puppies are sold under the assumption
that the Buyer’s home is permanent. Unless otherwise agreed, if at any
time in its life the dog is to be sold or given away, the Buyer shall so notify
the Seller and give the Seller first option to accept or buy the dog back. The
Seller will refund original purchase price up to 21 days after delivery
providing the animal is in healthy condition both physically and mentally.
After 21 days but not more than 20 weeks of age, the Seller will refund ½ the
selling price. There will be no charge to the Seller after the dog reaches age
20 weeks.
8. Because the parties recognize
that precise damages for breach of this provision might be difficult to ascertain
in the event of any breach by the Buyer of this provision of the contract, the
parties hereby agree that the Buyer will be liable for damages in the amount of
$500.00.
